At DashCharger (the "App"), your privacy is important to us. By using the App, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

1. PUSH NOTIFICATIONS AND FIREBASE CLOUD MESSAGING (FCM)

To provide you with essential updates regarding your charging sessions, balance alerts, and billing statements, our application uses Firebase Cloud Messaging (FCM), a service provided by Google.

1.1 Data We Collect: To deliver notifications to your specific device, FCM generates a unique FCM Registration Token ("Device Token"), which identifies your device for the purpose of sending messages.

1.2 How We Use It and Purpose: The token serves as a digital address for your device, allowing our servers to send notifications (such as "Charging Complete," "Low Balance," or billing reminders) directly to you.

1.3 Storage: We store this token securely and associate it with your user account so that you receive personalized notifications.

1.4 Third-Party Processing: The token is processed by Google through FCM for message delivery. For more information on how Google processes this data, please refer to Google's Privacy Policy.

1.5 Your Control: You may opt out of push notifications at any time through your device settings or within the application. However, opting out may prevent you from receiving important service updates related to charging sessions, balance status, or billing.

2. INFORMATION WE COLLECT

We collect different types of information to provide and improve our services:

2.1 Personal Information: We collect information such as your name, email address, phone number, payment details, and vehicle information when you register or use our services. This information is necessary to create your account, process payments, and provide you with our services.

2.2 Location Data: With your consent, we collect geolocation data to provide services such as locating nearby charging stations, navigating to charging stations, and providing location-based recommendations. You can disable location services in your device settings at any time, though some App features may be limited.

2.3 Usage Data: We gather data on how you interact with the App, including charging session details, preferences, and transaction history. As set forth in our Terms of Service, Dashcharger owns all right, title, and interest in and to this non-personal Usage Data (referred to as "Service Data" in our Terms). For more information, please refer to Section 4.4 of our Terms of Service.

2.4 Technical Information: To improve our services, we may collect data about your device such as IP address, operating system, device type, device identifiers, and App version.

2.5 Cookies and Similar Technologies: We may use cookies and similar tracking technologies to enhance your experience, analyze usage patterns, and personalize content. You can control cookie preferences through your device or browser settings.

3. HOW WE USE YOUR INFORMATION

3.1 Service Provision: Your data is used to operate and maintain our App, facilitate charging sessions, and enable transactions. This includes account creation, authentication, and customer support.

3.2 Enhancements: We utilize your information to improve our services and user experience, including analyzing usage patterns, identifying bugs, and developing new features.

3.3 Communication: We may contact you with service-related notices, billing updates, customer support responses, and (with your consent) marketing communications. You may opt out of marketing communications at any time.

3.4 Legal and Security Compliance: We ensure that your information is used to meet legal obligations, enforce our Terms of Service, protect our rights and property, and for security purposes, including fraud detection and prevention.

3.5 Research and Analytics: We may use anonymized or aggregated data for research, analytics, and statistical purposes to understand user behavior and improve our services.

4. INFORMATION SHARING AND DISCLOSURE

4.1 Service Providers: We may employ third-party companies to provide services such as payment processing, customer support, data hosting, and analytics. They will have access to your information only to perform necessary tasks on our behalf and are contractually obligated to protect your information.

4.2 Legal Compliance: Your information may be disclosed if required by law, regulation, or legal process, or in response to a valid request from law enforcement or government authorities.

4.4 With Your Consent: We may share your information with third parties when you have provided your explicit consent to do so.

4.5 Aggregated or Anonymized Data: We may share aggregated or anonymized data (Service Data) that does not identify you with third parties for research, analytics, commercial, or other purposes, as described in our Terms of Service.

5. CONSENT AND WITHDRAWAL

5.1 Consent: By using the App, you consent to the collection, use, and disclosure of your information as outlined in this Privacy Policy.

5.2 Withdrawal: You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting us through the details provided below. Withdrawing consent may affect our ability to provide you with certain services.

5.3 Opt-Out: You may opt out of certain data collection practices, such as location tracking or push notifications, through your device settings.

6. DATA SECURITY

We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, use, or disclosure. These measures include encryption, secure servers, access controls, and regular security assessments. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. ACCESS AND CORRECTION

You have the right to request access to your personal information and to seek correction of inaccurate or incomplete data. To do so, contact us using the information below. We will respond to your request within a reasonable timeframe and in accordance with applicable law.

8. RETENTION OF INFORMATION

8.1 Personal Information: We retain your personal information only as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. The retention period varies depending on the nature of the information and the purposes for which it was collected.

8.2 Service Data: As set forth in our Terms of Service, we retain Service Data (non-personal usage and telemetry data) for legitimate business purposes, including analytics, legal compliance, research, and service improvement. We may retain Service Data indefinitely.

8.3 Determination of Retention Periods: The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you;

  • Whether there is a legal obligation to which we are subject;

  • Whether retention is advisable in light of our legal position (such as for statutes of limitations, litigation, or regulatory investigations).

 

9. INTERNATIONAL DATA TRANSFERS

Your information may be transferred to, stored, and processed in countries outside of Canada, including the United States, where our service providers may be located. We ensure that such transfers comply with applicable laws, including PIPEDA, and that appropriate safeguards are in place to protect your information.

 

10. THIRD-PARTY LINKS

Our App may contain links to external sites or services. We are not responsible for the privacy practices of other websites and encourage you to review their privacy policies before providing any personal information.

 

11. CHILDREN'S PRIVACY

Our services are not aimed at children under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18 without parental consent, we will take steps to delete such information promptly.

12. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. We will notify you of any changes by:

  • Posting the new Privacy Policy on the App;

  • Updating the "Effective Date" and "Last Updated" date at the top of this Privacy Policy;

  • Sending you an email notification (if you have provided us with your email address).

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Privacy Policy. If you do not agree to the revised Privacy Policy, you must stop using the App.

Under PIPEDA, you have the following rights regarding your personal information:

  • Right to Access: You have the right to request access to your personal information held by us.

  • Right to Correct: You have the right to request correction of any inaccurate or incomplete personal information.

  • Right to Withdraw Consent: You have the right to withdraw your consent to our collection, use, or disclosure of your personal information, subject to legal or contractual restrictions.

  • Right to Challenge Compliance: You have the right to challenge our compliance with PIPEDA.
